VACATION RENTAL AGREEMENT
This Vacation Rental Agreement is by and between Authorized Tenant and Island Way Rental Properties, LLC
TERMS AND CONDITIONS: The rights and obligations of the parties to this agreement are defined by law. Your signature on this agreement, payment of money to secure the reservation or taking possession of the rental property is evidence of your acceptance of the agreement, and your intent to use the property for a Vacation Rental. ISLAND WAY RENTAL PROPERTIES, LLC; the management firm, on behalf of the owner of the property, rents the subject property to the tenant, subject to the provisions of the rental agreement.
FINAL PAYMENT: Your final payment is due 30 days prior to your scheduled arrival date via MasterCard, Visa, American Express or Discover. Any other method of payment must be approved by the owner/property manager. For example, if you wish to pay via cashier’s check or by money order, we will require a valid credit card to be kept on file to cover any incidental charges or applicable fees outlined in this Rental Agreement. Late checkout, trash left in vacation rental or grounds needing more than reasonable cleaning will result in additional cleaning charges; $50.00 per hour. Late checkout charge $50.00 per additional hour, if you would like an early check in (check-in before 4:00 PM) a charge of $50.00 per hour will apply.
RENTAL DAMAGE INSURANCE: Security deposits are processed through RDI (Renters Damage Insurance) with a one-time nonrefundable payment of $70.00. RDI provides coverage for accidental damage during your stay. The charge of $70.00 provides up to $1,500.00 in accidental damage coverage; this coverage is required for most units. If damages exceed the amount of coverage provided by RDI, the guest hereby authorizes ISLAND WAY RENTAL PROPERTIES, LLC to charge renter’s credit card for the cost of repairs, replacement, services, extra cleaning for damages, breakage and or loss incurred during his/her stay. In the event of damage to the premises, its equipment, furniture, or carpeting, guest shall be responsible for damage costs exceeding the security deposit and/or damage insurance, including collection costs and attorney’s fees. Documentation detailing damages and charges will be provided to the guest.
ACTS NOT PROTECTED:
- Acts of God
- Gross Negligence
- Intentional acts of a Covered Guest
- Willful Destruction of Property
- Normal Wear and Tear
- Theft without a Valid Police Report
- Covered Guest’s Personal Property
- Additional Cleaning Fees
- Property Damage by any Motorized Vehicle
ARRIVAL PROCEDURES: Most of our Beach Vacation Rentals have a KEYLESS ENTRY CODE. Please call Property Management prior to arrival to obtain code. If your unit requires a key to obtain access you will have to meet with your property manager, we ask that guests arrive no later than 9:00 PM to meet with your property manager. We understand unexpected delays can occur while traveling. If you are expected to be a late arrival, please contact your property manager immediately to make arrangements for access to your vacation rental.

WHAT TO BRING ALONG: To assist in deciding what to bring on your vacation, please take a moment to read the following information.
ALL vacation rentals are furnished with:
- Air Conditioning/Heating
- Coffee Maker
- Glassware, Cookware, and Flatware
- Pillows, Blankets, Sheets, Towels (For Indoor Use Only)
- Two (2) rolls of toilet paper in bathroom
- Paper towel roll in the kitchen
- Vacation rental is furnished
FEW or NO vacation rentals are furnished with:
- Beach Chairs
- Beach Towels
- Food of any Kind, including condiments
- Laundry soap, bath soap, dishwashing detergent
- Cribs, Highchairs, or Air Mattresses
CANCELLATION POLICY: Owner has offered favorable rental rates in this agreement based upon the total anticipated revenue for your stay. If this agreement is cancelled by the guest, the parties agree that the Owner will have lost the revenue represented by this agreement, and also the opportunity to offer your unused vacation rental to others and the owner will incur additional costs in attempting to resell inventory that was already sold to you.
Bookings canceled at least 60 days before the start of the stay will receive a 100% refund
There will be NO REFUNDS after the guest has paid their final payment, due thirty (30) days prior to arrival. We recognize there can be unforeseen emergencies that may cause you to cancel your reservation, therefore purchasing Travel Insurance is highly recommended. Should cancellation be necessary, advance deposits, rents or other fees will not be returned. NO refunds for early departure and/or eviction.
AGE REQUIREMENTS: We will not rent to vacationing students or singles under 25 years of age, unless accompanied by a parent(s). Any reservation made under false pretenses will be subject to eviction and forfeiture of advance payment of rent and deposits.
MANDATORY EVACUATION: Cancellation or early departure due to inclement weather including hurricanes, mandatory evacuations or states of emergency, does not warrant a refund for rent or deposit. Purchase of Trip Cancellation and Interruption Insurance is highly recommended.
SUBSTITUTIONS: Management strives to comply with all reservation requests for a specific vacation rental, however due to unforeseen mechanical problems, or other unforeseen circumstances, we cannot guarantee a specific rental property. We reserve the right to change assignments without notice should a residence become unavailable.
TERMINATION BY OWNER: Management strives to comply with all reservation requests for specific vacation rentals. However, due to ownership changes, properties being removed from rental use, mechanical problems or other unforeseen circumstances, we cannot absolutely guarantee a specific rental property. We reserve the right to change assignments without notice or liability should the unit or property become unavailable. When comparable accommodations are not available, guest will have the option to select from available properties at the published rate or receive a complete refund of their reservation deposit. We will not be held liable for refunding money tenant spent on transportation to arrive at vacation rental.
PROPERTY CONDITION: Please note that we have checked the unit before your arrival. If you have any remarks regarding the condition of the rental, please give us written notice within 24 hours after your arrival. This will be your evidence on check-out date.
PETS: If you are bringing a pet, you are completely responsible for any pet damage including cost of pet feces not picked up. All dogs must be no more than 25 lbs., leashed at ALL times when outside and must be supervised by owner.
REPAIRS: From time to time, it may be necessary for us to enter the vacation property during reasonable hours (8:00 AM-7:00 PM) for any purpose connected with the repair, care or management of the property. Every effort is made to keep items at each property in good working order. Please notify your property manager immediately if you are experiencing any difficulties during your stay; ensuring repairs can be completed as soon as possible. No rebates or reduction in rent will be made for mechanical failures or malfunctions, interruption of utilities or other maintenance problems such as air conditioners, heaters, dishwashers, washers, dryers, TVs, DVD players, swimming pools or appliances. Renter will be held responsible for any and all damages that occur during said rental dates.
MOVING FURNITURE: Do not move the furniture. Moving furniture could result in a fine of $500.00.
HOUSEKEEPING: Your accommodations have been cleaned before you arrive and after you depart. Guests are responsible for laundry needs during their stay. Please strip beds of sheets when checking out. All dirty dishes must be placed in dishwasher and dishwasher started. If there is no dishwasher, all dishes must be cleaned and placed in drying rack. Housekeeping will put dishes back in cabinets. All trash is to be placed in trash container outside upon your departure. Please do not leave trash in house. All food MUST be removed from refrigerator and freezer. Please do not leave any sugary items as this attracts ants.
NO SMOKING: Smoking inside vacation rental is strictly prohibited and will result in a $750.00 fine.
LOST AND FOUND: Management is not responsible for accident or injury to guests, or for loss of money, jewelry or valuables of any kind. Should you believe you left an item behind please contact us immediately and we will attempt to locate your lost item. Guest will be responsible to cover the cost of returning the item. If an item is found every attempt will be made to contact the guest; if we cannot reach you; unclaimed items will be donated to local charities.
BOATS, HAULING TRAILERS, MOTOR HOMES: NO motor homes, boats or hauling trailers allowed without owner or property manager’s permission. Please call before bringing any of these items as there is limited parking and some trailers are not allowed.
OWNERS SET SPECIFIC RULES: Regarding the maximum number of occupants, pets, smoking, etc. As the vacation rental management we enforce these rules, and may evict renters or their guests when they are exceeded. If pets are not allowed at the vacation rental, that includes pets belonging to your guests. Large gatherings, house parties, etc., are absolutely not allowed unless approved when your booking is made. Sub-letting is not permitted. Any disturbance resulting in neighborhood complaints, police action, illegal activities, damage to the vacation rental, or violation of this agreement or of rules and regulation governing the vacation rental, will be considered sufficient cause for immediate termination of your stay, and all monies paid will be forfeited. This agreement does not create a tenancy for the vacation rental; you can be removed from the vacation rental without process of law if you do not depart at the appropriate time. THE OWNERS, HOMEOWNERS ASSOCIATION, AND AGENT ARE NOT RESPONSIBLE for any injury to any tenants or tenants’ guests, or for loss, theft or damage to any tenants’ or tenants’ guests’ property your belongings whether associated with the rented unit, or the common property areas.
YOU AGREE TO NOTIFY US IMMEDIATELY: If a maintenance problem develops at your vacation rental so we can have it remedied as quickly as possible. Owners and Agent reserve the right to make repairs as necessary, and to enter the vacation rental with reasonable notice, or without notice if you cannot be reached.
RATES: All rates are subject to change. YOU ARE RESPONSIBLE FOR YOUR CHOICE. This vacation rental is privately owned and managed. We have described our vacation rental in detail to the best of our ability, but we cannot make the decision for you and will not be responsible if you are not happy with your choice on arrival. The rent will not be refunded and cannot be transferred to another location. BY SIGNING THIS AGREEMENT, THE TENANT AGREES TO “HOLD HARMLESS THE FLORIDA VACATION RENTAL COMPANY; ISLAND WAY RENTAL PROPERTIES, LLC IN ALL CLAIMS AND LEGAL MATTERS INCLUDING BUT NOT LIMITED TO: DOUBLE BOOKINGS, DEPOSIT MONIES, HURRICANES, FLOODS OR OTHER ACTS OF NATURE, DAMAGED PROPERTIES, FIRE, THEFT, LOST OR STOLEN PROPERTY, PEST INFESTATION AND CHANGES IN ZONING LAWS AFFECTING RENTALS, INJURY OR DEATH. THE TENANT UNDERSTANDS THAT THIS AGREEMENT IS BETWEEN TENANT AND HOMEOWNER [LANDLORD] AND ALL DEPOSIT MONIES BECOME PROPERTY OF LANDLORD
